So will/can Senate go nuclear with O-care?

Post by ElbertoHokie »

I don't remember all the details but saw that since 60 votes was obtained in passing a part of obamacare, the senate can't repeal it without another 60 vote majority. We know that currently this won't happen. Can they alter the rules or are they locked it to achieving 60 votes to totally repeal it?

I understand they can repeal parts of it. But one major part requires 60 votes I thought.

Yes, they can only use simple majority to repeal funding related matters (reconcilliation). For a blanket repeal they would have to go thru cloture I believe, which requires 60 to bring it to a vote.

I hope they don't change any rules more than they have. That would be a terrible precedent and destabilizing in the future. That said, I wouldn't be surprised if the democrats tried it when they're in power next.
